Ito South African law, a personal injury claim is a claim for compensation instituted by a person who has suffered harm as a result of the negligent conduct of another person.

For example, a claim for damages may arise from an injury sustained in a motor vehicle collision, slipping on a wet floor in a shopping mall or a dog bite.

The claimant may attempt to recover medical expenses, the cost of rehabilitation, loss of income, future loss of earnings, and/or general damages for pain and suffering. The quantum of damages, however, is limited by various factors, including the severity of the injury, the possibility of contributory negligence, existing insurance coverage, and the claimant’s age and life expectancy.
